Abstract:

Fr Stan Swami devoted four decades serving with Adivasis and Tribals in the province of Jharkhand. He answered the call to raise a democratic voice for the Adivasis and Tribals of the area to grant them the rights outlined in the 5th Schedule to the Indian Constitution. He might have claimed for rights under the 6th Schedule of the Indian Constitution, but instead he petitioned for rights under the 5th Schedule. He probably would not have suffered as much if he had voiced for 6th Schedule.


Fr Stan advocated for the Adivasi under the 5th Schedule, which was a valid demand, but we can see that most of the council creation in India appears under the 6th Schedule.


The fifth schedule has greater advantages than the sixth schedule, and Adivasi would have more rights under the fifth schedule. The presence of such wonderful provisions in the 5th and 6th Schedules of the Indian Constitution is a blessing for the people of India. It has been observed that the 6th Schedule or modified 6th Schedule is being implemented in many regions of India, which was also achieved after much effort and sacrifice by many other tribal people. Even though the provision is in the Indian Constitution, the 5th Schedule is not being applied to its full extent. Fr Stan is one of many people in Indian territory who are fighting for a constitutional rights that is guaranteed in the Indian Constitution but has yet to be implemented for the benefit of Adivasis, Tribals, and Dalits since the country's independence.


The Adivasis of Jharkhand are ST; yet, the same group is not ST in Assam, they along with five other communities, have been fighting for ST rights for decades. Since 1968, the Koch Rajbongshi tribe of Assam has been seeking ST, and the system is continuously playing with the innocent original son of India for the sake of vote bank policy. The Koch Behar Princely State was never a part of the newly established West Bengal province; instead, the Koch State is being merged with Assam, West Bengal, and parts of its territory with Bihar. It is highly appropriate to liberate the Koch Behar Princely State, and due recognition of the state should be honoured under the dominion of India.

Kamatapur or Cooch Behar is not a demand of new state; Cooch Behar State is included in the first Indian Constitution under the 'C' type of state. On August 28, 1949, the Koch King, HH Jagaddipendra Narayan Bhup Bahadur, signed a treaty with a delegate of the Government of India, and the Koch Country was amalgamated with India's dominion.


Fr Stan Swamy advanced the social democratic movement further than any other social democratic movement in our nation. Since he was raising a democratic voice for the rights, justice, and human rights of innocent inmates who are imprisoned without trial or justice, he attempted to bring justice and welfare to the innocent prisoners via the use of our country's legislation and constitution.


The condition described by Fr Stan is most likely widespread across the country. The illness of false acquisition and imprisoning an innocent person without trial or justice is spreading like a cancer cell. Fr Stan attempted to touch the tumor to heal the body and benefit humanity as a whole.
